TAWAU: The High Court yesterday sentenced a Filipino to death for the murder of a compatriot in 2007.
Judicial Commissioner Datuk Douglas Primus handed down the sentence on Abdul @ Wilson Arad, 32, after finding him guilty of killing Said Alian, 51, at 4.30pm in a house at B24A Jambatan 2, Kg.Kurnia Jaya, Batu 4, Jalan Apas on Aug 30.
The court ruled that the prosecution has proven its case beyond reasonable doubt against Abdul under Section 302 of the Penal Code which carries the mandatory death sentence by hanging, on conviction.
The arrest of Abdul was on March 16, 2010 for an immigration violation. Some of the immigration detainees recognised him and informed the authorities that Abdul was involved in the killing of Said in 2007. He was jailed six months before for using a fake identity.
A total of 11 witnesses testified against him in the murder trial, which was prosecuted by DPP Hamdan Hamzah.
Prior to the judgment, the court heard that a witness heard a man screamed and a scuffle ensued between two men.
He rushed to the scene and saw the accused and his son chased Said while armed with a Rambo knife while the son was holding a piece of wood.
He saw the accused stabbing Said.
