Murder: March 24 date for prison wardens, senior officer

KOTA KINABALU: The Magistrate’s Court here fixed March 24 for further mention of a murder case involving nine prison wardens and a senior prison officer.

Magistrate Lovely Natasha Charles fixed the date on Barry Jipmon, 30; Mohd Dzulfikri Mohd Safri, 28; Farizan Mokri, 41; Mohd Saiful Saidin, 35; Amran Yasik, 25; Ab Mutalib @ Talib Abd Rasul, 40; Zerry Maidin, 33; Tomy Momoh, 36; Shahryll Nazry Wan Sofian, 25; and Muhammad Fazi Lakui, 32, after being informed by the prosecution that they are still waiting for the post-mortem report.

On October 29, 2019, all the accused was brought to court and charged with murdering an inmate at the Kepayan Central Prison.

The charge stated that they allegedly had murdered one Shainal Mukthar, 36, at the prison cell, in Jalan Kepayan on October 4, 2019 at 4.30pm.

The offence is framed under Section 302 of the Penal Code and read with Section 34 of the same Code which provides a mandatory death sentence, upon conviction.

No plea was recorded from all the accused persons.

Earlier, during yesterday’s proceeding, Senior Federal Counsel, Khairul Anuar Abdul Halim informed the court that the chemist report was already completed but they are still waiting for the post-mortem report.

He then asked for a new date for further mention and, if possible, in March.

Counsel Ariel Dasan, who is one of the counsels representing the accused persons, raised no objection and left it to the court.

Ariel was together with counsels, PJ Perira, Hairul Vaiyron Othman and Dominic Chew in representing all the accused persons.

Counsel Mohd Azhier Farhan held a watching brief for the victim’s family. All the accused persons will be further detained pending disposal of the case. –ECA
