Caretaker gets 20-year jail term for sexual offence against two boys

KOTA KINABALU: The Sessions Court yesterday emphasised on the responsibilities and duties of adults as the caretaker of children and not to take advantage of them.

Judge Noor Hafizah Mohd Salim was saying this in her ruling before sentencing a local man to a total of 20 years’ imprisonment with three strokes of the cane for committing sexual offence against two boys.

According to Noor Hafizah, the accused, Wan Ruzaimie Mohd Kassim had committed a very serious and heinous offence, thus a deterrent sentence is needed to send stern messages so that would-be offenders and members of the public would be warned as offences committed against children is getting rampant nowadays.

Earlier, Wan had pleaded guilty to all three charges framed under Section 14 (d) of the Sexual Offences Against Children Act 2017, which carries a jail term of up to 20 years and also liable to whipping.

On the first count, he received eight years’ imprisonment with a whipping for kissing the mouth and licking the neck of the nine-year-old boy in the women’s prayer room of a mosque at a village of Papar between May 6 and June 19 last year.

For the second charge, he was sentenced to six years in prison with one whipping for inserting his private part into the mouth of a 10-year-old boy inside a car parked at the roadside of a village in Papar in April 2018.

For his third charge, he received another six years’ imprisonment and one stroke of the cane for committing a similar offence against the same boy at the same place in December 2018.

The court ordered the accused to run the jail term consecutively from the date of his arrest.

During mitigation, Wan Ruzaimie, through his counsel, asked for leniency on the ground that he is a single local Malaysian and needs to take care of his old parents.

He also told the court that he had been detained since July 18, 2019 and has already been under remand for eight months which had taught him a lesson.

In reply, Deputy Public Prosecutor, Nur Faezah Jafry urged the court to impose a deterrent sentence on Wan Ruzaime as he had committed a serious and heinous offence against the two minors.

She highlighted that the incident had caused trauma to the victims and Wan Ruzaimie had proceeded with his trial until the prosecution had established a prima facie case.

She then asked for the sentence to be served consecutively as the cases involved different victims. –NEDM
