I am saddened by the decision of the Federal court in affirming the decision of the Election Judge in nullifying my election as MP of Kimanis, even though I am not surprised.

I was in court this morning and was shocked to see that three members of the panel who had previously allowed Karim Bujang’s appeal on 18th November 2018, are also adjudicating my appeal.

On my instructions, my counsel Hj Ansari Abdullah had applied for the three judges to recuse themselves from hearing my appeal on three grounds:

a) They have sat in the previous appeal and had therefore formed an opinion on the same election petition and are therefore not neutral;

b) The practice and convention is that no Sabah judges will adjudicate on election petitions filed in Sabah; and c) Several grounds of today’s appeal are related to the decision of the previous panel.

Despite promising to write the grounds of judgement, the panel that sat on 18th November 2018 had not done so until today.

I am not surprised if today’s panel will not give a written grounds of judgement.

Though I have won the allegations against me and were awarded costs of RM105,000.00, I have to file today’s appeal to defend the decision of the voters in Kimanis. I nevertheless thank SPR for supporting today’s appeal. I will go back to Kimanis and discuss with my supporters on my next course of action.
