KOTA KINABALU: A 60-year-old traditional healer who was convicted of raping his 20-year-old patient was ordered to serve 12-year imprisonment after his application for a stay of execution was dismissed by the High Court yesterday.
Judge David Wong Dak Wah ruled yesterday that there were no special or exceptional circumstances to allow the accused a stay.
Idris Kambali was sentenced by Session court judge Ravinthran N Paramaguru on Dec 26, 2008 after he was found guilty of committing the crime in an unnumbered house in Tg Wakap, Kota Belud at 1.30pm on Jan 21, 2007.
Idris appealed against his conviction last June 26 but his appeal was dismissed.
The following day on June 27, Idris who was represented by counsel Angela Ubu applied for a stay of execution pending appeal to the Court of Appeal but was rejected.
Meanwhile, in the Magistrates’ court, a 28-year-old man accused of cheating another man by failing to return his car and not settling the rent was ordered to appear in court next month.
Magistrate Dana Arabi Wazani released Adrian Lee Kah Chieh on a bail of RM3,000 deposited under two local sureties after he pleaded not guilty to cheating Ho Yin Vui, 28.
Dana order the accused to appear on Aug 3 to answer the charges of which he was accused of.
Adrian, of Gaya Park allegedly committed the offence at Sinar Light Industry Mile 6 1/2, Inanam at 10am on May 15 this year.
