Robbing Russian tourist: Security guard jailed nine years

KOTA KINABALU: A security guard was sentenced to nine years’ jail for robbing a Russian tourist.

Muhammad Ali Edi was also ordered to be whipped once after he pleaded guilty to the charge under Section 392 of the Penal Code which carries a jail term of up to 14 years and liability to a fine or whipping.

The 26-year-old accused who appeared before Sessions Court Judge Ainul Shahrin Mohamad had robbed the Russian woman by the side of Zara’s Boutique Hotel along Jalan Coastal on July 5 at 6pm.

According to the facts of the case tendered by Deputy Public Prosecutor Rustam Sanip, prior to the incident, the victim and her mother were on their way to Imago Shopping Mall when they suddenly bumped into the accused who came from the opposite direction and grabbed the victim’s handbag.

The victim then shouted for help after failing to hold on to the bag containing her personal belongings. Fortunately, a passer-by who overheard the screams pursued the accused who escaped towards Kampung Sembulan. Muhammad Ali was later arrested with the help of the villagers.

All the robbed items were recovered and the accused was identified by the victim during an identification parade. In mitigation, the unrepresented accused asked for leniency on the grounds that he is taking care of his two small children including his schooling siblings.

Rustam, however urged for a deterrent punishment to be imposed on the accused by taking into consideration public interest and the rampancy of such cases involving tourists as their prey.

Muhammad Ali’s jail term was effected from his date of arrest.

Meanwhile, six immigrants including a woman were jailed four months for illegal entry.

Mohamad Hasan, Angelou Tilau, Anuar Bensali, Al Munib Balahim, Ajlan Muksan and Fetimah Jenilyn who admitted to the offence were caught separately between May 25 to July 7 at different locations in Papar, Kota Kinabalu and Kudat.

The offence framed under Section 6 (1)(c) of the Immigration Act 1959/63 carries a maximum fine of RM10,000 or a jail term of up to five years or both and with whipping.

Sessions Court Judge Azreena Aziz ordered all the men to be whipped once while the woman was spared the whip. The immigrants will be referred to the Immigration Department after their incarceration. – NEDM
