Man who punched traffic cop in viral video fined RM2,800

KOTA KINABALU: A young man whose viralled video of him punching a traffic policeman in the head at the scene of an accident in Kota Belud, recently, was punished yesterday.

Ilyas Shah Ishak, 20, admitted to his wrongdoing and made an open apology to the victim and all public servants. The Magistrate’s Court fined him RM2,800 in default 10 months’ imprisonment.

Ilyas had used criminal force to deter Corporal Mohd Azli Adnan from discharging his duties of taking pictures at the accident scene on Feb 16, at 3.15pm at a roadside near the roundabout of Kg Lebak Moyoh in Kota Belud.

Ilyas was convicted under Section 353 of the Penal Code which carries a maximum two years’ imprisonment or a fine or both.

Prosecuting officer Inspector Suhaiyu Suffyian told Magistrate Afiq Agoes that traffic police were informed of a road mishap between a Myvi and a motorist. When Mohd Azli arrived at the scene, he immediately took photos of the accident.

Two angry men confronted Mohd Azli and as the latter was introducing himself, Ilyas came from behind and punched his head.

The accused’s father had apologised to Mohd Azli but the latter went ahead to lodge a police report.

During mitigation, the accused who was represented by three Counsels comprising Syarulnizam Salleh Keruak, Shahlan Jufri, and Azhier Farhan Arisin tendered an open apology in court.

He apologised to Mohd Azli, his wife and family along with the civil servants.

Ilyas admitted his wrongdoing but stressed that he did not have any intention to injure the victim. He also said that he respected government staff all this while and has never violated the law.

However, Ilyas said during the incident, he was agitated as the brother and cousin were involved in the accident.

The young man recalled that he had a bad experience and would be traumatised every time he heard about a motorcycle accident, as his close friend had died in March 2016, after being run over by a truck before they managed to take their SPM results.

In June last year, Ilyas’ father was also involved in a motorcycle accident in their village.

Ilyas became worried when no one could tell him what happened in the accident involving the brother and cousin.

“I admitted my mistake. I understand this incident has become a public discussion because there is a video footage of an event that has been widely spread in ‘WhatsApp’ and social media sites. I hope with this statement I can clear my family’s name because I feel sorry and cannot stand to see my parents and my family being criticised.

“I am really sorry for my mistake and would like to apologise for what I have done. I promise to learn from my mistake and to be a better man devoted to the nation,” he said. – ECA
