Two deny supporting terrorist group

KOTA KINABALU: Two local men who were separately charged with providing support to the Islamic State (IS) terrorist group have pleaded not guilty.

Md Ayub Idris, 33, will stand trial on Sept 26 – 29, while Saifullah Sulaiman, 28, will stand trial on Oct 30 to Nov 3 at the High Court.

Judge Ravinthran Paramaguru fixed the tentative trial dates and also set Aug 22, for case management on both cases.

In the first case, Md Ayub is accused of knowingly canvassing support for IS by giving oath (berbai’ah) via social media Telegram inside chatting group “gagak hitam” using his own phone number with a name of “Ihsahn” on March 30, 2016 at 12.34am B16-2-12, Taman Telipok Ria, Jalan Tuaran, Telipok in Tuaran.

The offence is framed under Section 130J (1)(a) of the Penal Code which carries a life imprisonment for a term of up to 30 years, or with a fine and shall also be liable to forfeiture of any property used in connection with the commission of the offence.

Meanwhile, Saifullah is accused of committing similar offence by giving oath via social media application namely Telegram inside chatting group “gagak hitam” using a name of Ahadun Ahad and using his own phone number.

He allegedly committed the offence on March 29, 2016 at 11.46pm at Lot 188 Phase 11, Jalan Pahlawan, Lorong Bunga Patuma, Rumah Murah Kepayan.

For the second charge, Saifullah is accused of giving support to the act of terror which involved the use of explosives via Telegram inside chatting group “amanah (phb) vs pas)” using his phone number with a name of Ahadun Ahad.

The alleged offence was committed on June 28, 2016 between 3.41am and 4.10am at the same place. The charge framed under Section 130J (1)(b) of the same Code provides for the same punishment. Both accused were further detained under section 259 CPC until the disposal of the trial.

Counsel Ram Singh represented both accused while DPP Muhammad Fazlan Mohd Noor prosecuted the case. Muhamad informed the court that the prosecution intended to call 10 to 15 witnesses during the hearing and they also have one protected witnesses for each cases. – ECA
